Three companies have pleaded guilty to charges relating to the illegal depositing of construction and demolition waste, for the purpose of building a haul road at Hurst Plantation near Doncaster.

At Doncaster Magistrates’ Court on Tuesday the 7th of May, Wykeham Estates (Northern Ltd) were fined £3,000.00 and ordered to pay costs of £5,500.00; additionally the Judge gave them an order under Regulation 44 of the Environmental Permitting Regulations for Wykeham Estates to remove the waste to a lawful disposal facility within eight months.
Westmoreland Waste Recycling and Bolland Skip services Ltd also fined and ordered to pay £5,500.00 in costs. It was revealed that the Environment Agency started investigations at the Hurst Plantation site in May 2011, therefore when members from the Environment Agency’s Environmental Crime Team visited the site they discovered that approximately 1,350 tonnes of waste had been unlawfully disposed of.
It has been reported that the Environment Agency also found a dirt track which had been turned into a road laying three of four feet above ground level; it appeared to me made up of soil, plastic containers, tarmac and waste metal as well as house bricks, breeze blocks and general demolition waste which was later found to contain asbestos.
It was said that the illegal waste activities were on-going between July and November 2011, the court was informed after further visits and investigations relating to the site and it also showed the involvement of the three companies.
During sentencing, District Judge Bennett stated how Parliament has made the Environmental Permitting Regulations to protect the environment and that the £50,000 statutory maximum fine in the Magistrates’ Court demonstrates how seriously environmental crime is to be treated.
He added that this was a reckless breach of the law by Wykeham Estates with the potential to cause environmental harm and that as both Bolland and Westmoreland have been in the waste industry for a long time, they should have been aware of the legal requirements.
Following the case, an Environment Agency Officer in charge of the investigation, said:
“Illegal waste sites and in this case, where asbestos and other harmful contaminants were found in the waste, has the potential to cause serious pollution incidents or harm human health.
“This prosecution demonstrates that we take waste crime very seriously and will not hesitate to prosecute if necessary, to protect the environment and local communities.”

Here at GPT Waste February month has come and gone quickly, however, there are plenty of things to look forward to in March but, before we do here is a quick re-cap of everything that has happened at The Waste Solution.
The Waste Solution wins total waste management contract for the MoD
The largest UK independent provider of waste management solutions and sustainable waste services has won a three year, total waste management contract with the Ministry of Defence (MoD).
The project is for the provision of total waste management services across approximately 40 MoD sites of varying sizes ranging from Army Careers Information offices to barracks.
The three year contract started in February 2013 and will see waste streams including recyclate, hazardous, confidential and clinical be completely managed by leading waste management company GPT – The Waste Solution.

A site visit was undertaken immediately, in order to assess the logistics of the job and also to understand both the process from which the waste was produced and the make- up of the waste.
A sample was taken within 24 hours of the request and sent for analysis by GPT. RoRo containers were discussed but after consideration were deemed to be unsuitable due to the loose nature of the powder and potential problems which could arise during the disbursement of waste around site.

Leisure Industry Waste Management Case Study – Kudos in Brighton
GPT were asked to review the waste provision at the site following continual issues with service, poor recycling rates of less than 30% and a general lack of management information.
A full site review was undertaken and various waste streams identified. Recommendations were then made to the Site Manager to improve service, reduce costs and increase recycling rates.

Energy from Waste report published – exploring the role energy might have in waste management
The Department for Environment, Food and Rural Affairs has published the Energy from Waste report as a guide to the debate.
It is clear that the Government is focusing on preventing waste as well as ensuring that any waste is viewed as a valuable resource therefore they would ideally have waste either reused or recycled. It is also Government policy that efficiently recovering energy from residual waste has a valuable role to play in both diverting waste from landfill and energy generation.
The Energy from Waste report has therefore been published to provide a starting point for discussions about the role energy from waste might have in managing waste. This role will however always be dependent on specific circumstances therefore the guide does not provide all the answers but highlights the questions that we should be asking.

In July of this year The Waste (England and Wales) (Amendment) Regulations 2012 were seen by ministers in an attempt to draw a line under the on-going legal dispute over collection methods.
Within this new amendment it stipulates that named recyclable material should be collected separately where necessary and where it is “technically, environmentally and economically practicable.”

Defra and the Welsh Government were forced to amend the law when reprocessors and opponents of commingled collections, concerned about recyclate quality, brought a judicial review (JR). The JR was halted in December 2011 after the Government said it would make a fresh attempt at transposing the EU revised waste framework directive (rWFD).
Although waste management firms as well as local authorities have supported the amendment that will effectively allow commingling, opponents have said that it is not good enough.
Andy Moore, from the Campaign for Real Recycling (CRR) which began this legal challenge last year, spoke out in July and said that the amendment was “still not an adequate transposition of the revised Waste Framework Directive”.
Former government official and WRAP head of local authorities, Phillip Ward, mentioned that he was concerned about the “low level of awareness” of the new regulations amongst councils and others.
Phillip Ward said:
“Legal arguments are continuing, but councils who think this is blanket permission to carry on commingling may be disappointed.”
Ward also said that council letting new contracts would need to show separate collections had been properly evaluated and that conditions for material sorting quality had been set for commingling.
He added:
“They should not forget their separate duties under the waste hierarchy which is now included in the regulations and is another reason why they need to know what happens to their material after collection. This may also affect material sent for EfW. Incinerators which do not achieve R1 status count as disposal and not recovery and are lower down the hierarchy.”
Whilst allowing commingling to continue, Defra has failed to publish a consultation on the MRF code of practice and quality action plan, this is a vital plank of the governments’ strategy to increase recyclate quality.
This consultation was expected to be published in August however; it was delayed until September to include other Defra measures.
The consultation follows months of discussions between interested parties, with opposing groups reluctant to give up ground to the others.
Recyclers and reprocessors want tighter regulations of quality standards and it is said that MRF operators and waste management firms are focussing on maximum recycling and market transparency.
A Defra spokeswoman said she was unable to give a date for the consultation launch at this stage.
The amended Regulations
The amended Regulations relate to the separate collection of waste.
- They amend the Waste (England and Wales) Regulations 2011 by replacing regulation 13 to separately collect waste paper, metal, plastic and glass from January 2015.
- It also imposes a duty on waste collection authorities, when making arrangements for the collection of such waste, to ensure that those arrangements are by way of separate collection.
- These duties apply where separate collection is “necessary” to ensure that waste undergoes recovery operations in accordance with the Directive and to facilitate or improve recovery; and where it is “technically, environmentally and economically practicable”.
- The duties apply to waste classified as waste from households and waste that is classified as commercial or industrial waste.
- The amended Regulations also replaced regulation 14(2) to reflect the changes to regulation 13 to ensure a consistent approach. Consequential changes are also made to reflect changes in paragraph numbering in the new regulation 13

Staffordshire County Council has announced encouraging plans to significantly reduce the level of waste sent to landfill.

Local authorities play a major role in increasing recycling rates as well as working towards the diversion of biodegradable waste from Landfill. By 2015/16, this particular council has pledged that 95% of its’ recyclable waste will be diverted from landfill as part of The Waste Local Plan. They have also proposed that by 2020/2, this figure will reach 100%.
The Waste Local Plan outlines improvement measures for waste management and sets out to move away from disposal in favour of more sustainable methods of treatment such as recycling, composting and waste-to-energy incineration.
The joint partnership between Stoke on Trent City Council and Staffordshire Country Council is designed to enhance the region’s approach to waste management and provide a guide to the types of new waste management facilities that are required for waste-to-landfill to be reduced.

Most waste to landfill ‘cannot be justified’ according to Lord Taylor.

In a recent article published by Business Green, the Environment Minister promises renewed ambition from Defra on everything from plastic bags to air pollution.
Over the past couple of months Defra has been busy with a series of announcements that could have major implications for green businesses and sustainability executives.
Whilst discussing the department’s recent announcements, with Environment minister Lord Taylor of Holbeach, the plans for next year were also discussed, these included; imminent developments in the fields of waste management, sustainability reporting and air pollution.
During a meeting with Business Green, Lord Taylor said; that they are working with the clothing industry and that is another area of a similar nature we are looking to see how we can help the industry organise itself to improve performance.
According to the minister, that is what lies at the bottom of these voluntary agreements.
Lord Taylor said:
“They really started off with the Cortauld Agreement and I think the big advantage is that to have success you need to have buy-in, and the only way to get buy-in is to get all sides of a supply chain to think in terms of what they can do to get the value out of the waste they are generating and reduce the waste they are generating.”
He went onto say:
“Beyond clothing there is nothing immediately that we’re looking at, though one of the areas where we are having a renewed focus is stopping timber and wood going into landfill. But I suspect that will not be a voluntary agreement-type deal, it’s more likely to be investigating ways we can ultimately get wood out of our landfill. We will consult on those plans. We are required to consult and it makes sense to consult.”

Courtauld Agreement – Courtauld Commitment 1
The Cortauld Commitment is a responsibility deal aimed at improving resource efficiency and reducing the carbon and wider environmental impact of the grocery retail sector.
Over the past 5 year 1.2 million tonnes of food and packaging waste has been prevented through the success of Phase 1 of this commitment, the results were published in September 2010, showing that 670,000 tonnes of food waste and 520,000 tonnes of packaging were avoided across the UK between 2005 and 2009.
Two out of the three original targets were met over this time scale, these were:
- to design out packaging waste growth (zero growth achieved in 2008); and
- to reduce food waste by 155,000 tonnes (exceeded with 270,000 tonnes less food waste arising in 2009/10 than in 2007/08).
The target to reduce the amount of packaging waste over the same period – has not been achieved. Total packaging has consistently remained at approximately 2.9 million tonnes between 2006 and 2009.
Courtauld Commitment 2
The second phase follows on from the original Courtauld Commitment (Phase 1), however, it moves away from weight-based targets and aims to achieve more sustainable use of resources over the entire lifecycle of products, throughout the whole supply chain.
When Phase 2 was launched on the 4th of March 2010, 29 main retailers and brand owners had already pledged their commitment to this voluntary agreement. Today there are over 50 signatories.
Phase 2 targets include:
Packaging – to reduce the weight, increase recycling rates and increase the recycled content of all grocery packaging, as appropriate. Through these measures the aim is to reduce the carbon impact of this grocery packaging by 10%.
Household food and drink waste – to reduce UK household food and drink waste by 4%.
Supply chain product and packaging waste – to reduce traditional grocery product and packaging waste in the grocery supply chain by 5% – including both solid and liquid wastes.
