Legal Update : Environmental Permitting (England and Wales) (Amendment No 2) Regulations 2009

Date: Friday, February 12, 2010. Posted in GPT News

The government is revising the list of waste activities that are exempt from environmental permitting.

GPT respectfully remind our Customers and Service Providers to review the draft guidance to ensure any waste activity they carry out complies with the existing, and the changed requirements. The amended regulations are expected to come into force on 6th April 2010 Certain low level environmental impact waste activities are exempt from the requirements of the Environmental Permitting (England and Wales) Regulations. They are regarded as “simple exemptions”

"Baling, compacting, crushing, shredding or pulverising waste at the place where it is produced (together with storage prior to the activity)" is an example of an exempt activity.

The Environment Agency requires any organisation operating such an activity to officially notify them. This will enable the activity to become registered.

The exemption relevant to this activity is explained in paragraph 27 of the regulations. Further information on exemption registration can be found at:- http://www.environment-agency.gov.uk/business/topics/permitting/32328.aspx
